The terms for orders at N-Works 3D, for businesses and for consumers. For consumers, the special provisions of article 20 also apply.
These general terms and conditions are those of N-Works 3D, the trade name of the sole proprietorship of Yves De Boitselier, with registered office at Oscar Declercqstraat 27, 9750 Kruisem, Belgium, registered with the Crossroads Bank for Enterprises (KBO/BCE) under enterprise number 1027.765.676, VAT number BE1027.765.676. N-Works 3D can be reached by email at info@nworks3d.be and through the contact form at quote.nworks3d.be/enquiry. N-Works 3D usually replies within 24 hours and at the latest within 48 hours, excluding weekends and Belgian public holidays.
These terms apply to every quote, order and agreement between N-Works 3D and the client, whether the client is a business or a consumer; for a consumer, the special provisions of article 20 also apply. The terms are communicated to the client before the contract is concluded, among other things with the quote. The client accepts them by signing or confirming the quote or order form, by a written confirmation or a confirmation by email, or by the start of the work. Deviations apply only when confirmed in writing. The client's own terms do not apply unless N-Works 3D has expressly accepted them in writing.
A quote from N-Works 3D is valid until the date stated on the quote, by default 30 days after the quote date; within that period the price does not change. The agreement is formed when the client pays or expressly confirms the quote within that period, in writing, by email or with the confirm button.
Where the client sends a request through the online quoting tool, that is a request for a quote, not an order. N-Works 3D reviews the request and replies within 48 hours at the latest, excluding weekends and Belgian public holidays, with a quote or with a refusal. N-Works 3D may decline or adjust a request where the uploaded file is not printable, the chosen material is not in stock, the part falls under export rules or another legal restriction, or for a similar technical reason; the client then receives a new proposal, which the client is free to accept or decline. The price calculated by the quoting tool does not increase, unless the client asks for additional work and accepts the new price. The agreement is formed only when the client pays or expressly confirms the quote; until then both parties are free. Nothing is charged before that moment; should this happen regardless, the amount is refunded immediately.
The request goes through three steps: entering the file, the choices and the details; reviewing everything and clicking "Send request"; and then paying or confirming the quote. Until the client clicks "Send request", the client can review and correct every entry. N-Works 3D keeps the agreement and the accepted version of these terms; the client receives the quote as a PDF. The agreement can be concluded in Dutch, English or French.
Prices are in euro and exclusive of VAT unless stated otherwise. Shipping is charged separately. Priority (Fast or ASAP) may carry a surcharge. N-Works 3D sends its invoices and credit notes to VAT-registered businesses established in Belgium as structured electronic invoices through the Peppol network (standard EN 16931), as Belgian law requires since 1 January 2026. If such a client cannot receive a structured electronic invoice for technical reasons, that client receives its invoice in PDF format by email, as the law then allows, and agrees to this. Other clients receive their invoice in PDF format by email and agree to this by accepting these terms. Payments are made to account IBAN BE98 3632 6390 3593, unless stated otherwise on the invoice. If a specific brand or type of filament is temporarily unavailable, N-Works 3D uses an equivalent alternative only with the client's consent; the quoted price never increases as a result.
Invoices are payable within 30 days of the invoice date unless agreed otherwise; a deviating payment term never exceeds 60 days. Where a business asks to pay on invoice with a term of 30 or 60 days instead of at the order, the quote may state a surcharge for it. In case of late payment, the statutory interest, a fixed compensation of 40 euro and reasonable compensation for the other recovery costs are due by operation of law and without notice of default, in accordance with the Belgian Act of 2 August 2002 on late payment in commercial transactions. An invoice that is not disputed in writing, stating reasons, within 14 calendar days of the invoice date is, subject to proof to the contrary, deemed accepted. In case of overdue payment, N-Works 3D may suspend further work and deliveries, including under other current orders, until full payment.
Delivered goods remain the property of N-Works 3D until full payment of the price, including any costs and interest. Until then, the client may not resell, pledge or encumber the goods. The risk nevertheless passes to the client upon delivery or, in case of shipment, upon handover to the carrier, unless agreed otherwise. In case of non-payment, N-Works 3D may take back the goods, without prejudice to its other rights.
Physical parts supplied by the client (for example for 3D scanning or reverse engineering) remain the property of the client. The client sends a part only after written agreement from N-Works 3D; an email is enough. The client states in advance the value and any particular risks of the part. N-Works 3D may refuse a part, for example because of its value or risks. Transport to N-Works 3D is at the client's risk.
N-Works 3D keeps supplied parts with the care of a normally prudent professional and is liable for their loss or damage in case of fault. That liability is limited to the actual value of the part, up to the value the client stated in advance; if the client stated no value, the limitation in article 13 applies. This limitation does not apply in case of intent, fraud or gross fault. For other damage, such as downtime or consequential loss, article 13 applies.
A part that is already broken, worn or brittle may suffer further damage during measuring or scanning; without fault on the part of N-Works 3D, this is at the client's risk. Operations that permanently alter the part, such as disassembling or cutting it, are carried out only with the client's agreement.
N-Works 3D returns the part, together with the delivered goods if there are any; the risk during that shipment follows the same rules as for the delivered goods (article 5, and for a consumer article 20). At the client's request, N-Works 3D ships the part insured up to the stated value, insofar as the carrier offers this; the cost of that insurance is borne by the client. N-Works 3D may retain supplied parts and results until full payment of the order (right of retention).
The client provides correct and complete files or specifications and holds the necessary rights to the supplied material. The client indemnifies N-Works 3D against third-party claims regarding the supplied design or its use. N-Works 3D does not reproduce anything that infringes third-party rights. The client declares that the part and the supplied data are not subject to export control (such as ITAR, EAR or the European rules on dual-use items), sanctions or another legal restriction, or provides the necessary licences. N-Works 3D may refuse or suspend a request or order that falls or may fall under such rules, and does not make weapon parts.
Standard, Fast and ASAP describe when PRODUCTION STARTS, not when the shipment reaches the customer. Standard means production starts from five business days. Fast means production starts within two to five business days. ASAP means production starts within twenty-four hours. These periods begin on the first business day after the agreement was formed (article 3) and, where a deposit or advance payment has been agreed, after that payment has been received. On top of the start period come printing time, post-processing, inspection and the carrier transit time; that transit time is outside the control of N-Works 3D. A delivery date is binding only where it has been expressly agreed in writing to be binding. Otherwise stated periods are an estimate which N-Works 3D makes reasonable efforts to meet, and a reasonable overrun gives a business customer no right to damages, rescission or refusal of the goods, save for intent or gross negligence. For a consumer, article 20 applies. Business days are Monday to Friday, excluding Belgian public holidays.
For reverse engineering and 3D scanning, the standard result is the reproduced part, ready to use. The CAD file (such as STEP) is available only on request and at extra cost, as a separate option. Native parametric modelling data is not supplied. N-Works 3D offers the CAD file, 3D scanning as a separate service (with a scan or model as the result) and consultancy to businesses only; a consumer can order a reproduced part. The client receives the right to use the delivered part for the agreed purpose. The design and CAD value, the working methods and the know-how of N-Works 3D remain with N-Works 3D, also after delivery of the part.
For original design work that N-Works 3D develops for the client, the intellectual property of the design remains with N-Works 3D, unless agreed otherwise in writing. The intellectual property rights in the design are transferred to the client where this is expressly agreed in writing and the fee agreed for it has been paid in full, to the extent the law permits such transfer. The author's moral rights remain with N-Works 3D, as the law prescribes.
The quality system of N-Works 3D is based on ISO 9001:2015; N-Works 3D is not certified and no external body audits it. Every order is made with the same care and visually checked.
The quality record is an option per order and must be chosen before production starts: photographs taken during printing cannot be produced afterwards. Where a record is chosen, N-Works 3D documents the batch number of the material used, photographs during and after printing, a dimensional check of the finished part, and a PDF report supplied with the delivery. Checks are carried out with established working methods, not with formal laboratory calibration.
The record is an account of what was checked. It does not extend the liability or the warranty set out in these terms.
The client inspects the delivery on receipt. The client reports visible defects in writing within 8 business days of receipt. The client reports hidden defects in writing within 14 calendar days of discovery and no later than 6 months after delivery. Reports are sent by email to info@nworks3d.be. In case of a defect reported in time and justified, N-Works 3D repairs or replaces the delivery, or credits the amount concerned; further claims are limited in accordance with the limitation of liability set out in these terms.
Parts are made to order. If the client cancels an order in whole or in part after the agreement was formed (article 3), the client compensates the work already performed and the materials and costs already incurred or ordered, increased by a fixed compensation of 15% of the remaining order amount, without prejudice to the right of N-Works 3D to prove higher actual damage.
N-Works 3D is liable for damage caused by its fault, limited to direct damage and to a maximum of the amount of the order concerned. N-Works 3D is not liable for indirect damage such as consequential loss or loss of profit. These limitations do not apply in case of intent, fraud or gross fault, nor in the cases where the law does not allow a limitation of liability, such as for damage to life or health.
The statutory right of withdrawal applies to consumers only. Where the client acts as a business, it does not apply. For a consumer, article 20 applies, including the statutory exception for made-to-order goods.
N-Works 3D processes personal data of the client and of the client's contact persons, in particular identification and contact details and order and invoicing data, in order to carry out the order, invoice, communicate about the order and keep the statutory accounts. The legal basis for this processing is the performance of the agreement (article 6.1.b GDPR) and compliance with legal obligations (article 6.1.c GDPR). The data is kept for as long as the law requires; for invoices, credit notes and other accounting records this is seven years in Belgium, counted from 1 January of the year after their date. Every data subject has the right of access and the right to rectification, erasure, restriction of processing, objection and data portability; a request to that effect can be sent by email to info@nworks3d.be. Every data subject may also lodge a complaint with the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit), Drukpersstraat 35, 1000 Brussels.
The client's files and project information remain confidential and are used only to carry out the order. N-Works 3D does not disclose them to third parties, unless this is necessary for carrying out the order or required by law.
N-Works 3D shows finished work in its portfolio, on its website or on social media only with the client's express prior consent. Files, drawings and technical specifications are never published. Consent once given may be withdrawn at any time for future use.
In case of force majeure, obligations are suspended for as long as it lasts. Neither party is then liable for the resulting delay. If force majeure lasts longer than 60 days, either party may terminate the agreement in writing for the part not yet performed, without compensation. Work already performed is paid for.
If a provision of these terms is void or unenforceable, the remaining provisions remain in full force. The void provision is replaced by a valid provision that comes closest to its intent.
These terms and every agreement between N-Works 3D and the client are governed by Belgian law. Disputes between businesses fall under the exclusive jurisdiction of the business court of Ghent (ondernemingsrechtbank Gent). For disputes with a consumer, the statutory jurisdiction rules apply, as set out in the special provisions for sales to a consumer.
This article applies only where the client is a consumer, that is a natural person acting for purposes outside his trade, business, craft or profession. For that consumer, by way of derogation from the preceding provisions of these terms, the following rules apply.
Right of withdrawal. In the case of a distance contract, the consumer in principle has a period of 14 calendar days to withdraw from the contract without giving reasons. This right of withdrawal does not apply, however, to goods made to the consumer's specifications or clearly personalised, in accordance with the statutory exception of article VI.53, 3 of the Belgian Code of Economic Law. The right of withdrawal therefore does not apply to parts made according to the consumer's files or specifications. For other goods, the statutory right of withdrawal of 14 calendar days applies. The consumer is informed of this before sending the request.
Delivery. Where no express delivery period has been agreed, N-Works 3D delivers no later than thirty calendar days after the contract is concluded. If N-Works 3D fails to deliver in time, the consumer may grant an additional reasonable period; if that period also expires, the consumer may rescind the contract free of charge and any amount paid is refunded without delay. The limitation in article 8 on overrunning periods does not apply to a consumer.
Risk. For a consumer, the risk of loss of or damage to the goods passes only when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.
Cancellation. Article 12 does not apply to a consumer. If a consumer cancels an order after the agreement was formed, the consumer only compensates the work already performed and the materials and costs already incurred or ordered.
Statutory conformity guarantee. The consumer enjoys the statutory guarantee of two years on the conformity of the delivered goods, as provided by Belgian law. That period and the consumer's other statutory rights are not shortened or restricted by these terms. The shorter periods for complaints and defects in these terms do not apply to a consumer.
Prices. Prices communicated to a consumer always include VAT and all mandatory charges. Shipping costs are stated separately and before the order is placed.
Payment. A consumer pays at the time of the order or after approval of the quote, or, where agreed, through a deposit with payment of the balance as agreed, or, where so agreed in the quote, at pickup of the order. Invoice payment terms (such as 30 or 60 days) are offered to businesses only.
Late payment. If a consumer fails to pay, N-Works 3D first sends a free initial reminder. Interest and a fixed compensation are only due after a period of 14 calendar days has expired, starting on the day after that reminder is sent (for reminders sent by post, on the third working day after sending), and only within the statutory maxima of Book XIX of the Belgian Code of Economic Law. The late-payment regime between businesses in these terms, including the fixed compensation of 40 euro, the interest due by operation of law without notice of default and the 14-calendar-day invoice acceptance period, does not apply to a consumer.
Invoicing. A consumer receives a regular invoice or payment confirmation in PDF format; the electronic invoicing through Peppol in these terms applies between businesses only.
Liability. The limitations of liability in these terms apply towards a consumer only to the extent permitted by mandatory consumer law. They do not affect the rights the consumer derives from mandatory statutory provisions.
Complaints and disputes. A consumer can address any complaint to info@nworks3d.be. If the parties cannot resolve the matter together, the consumer may turn to the Belgian Consumer Mediation Service (Consumentenombudsdienst, North Gate II, Koning Albert II-laan 8 bus 1, 1000 Brussels, www.consumentenombudsdienst.be) for out-of-court dispute resolution.
Competent court. In the event of a dispute with a consumer, the statutory rules on jurisdiction apply, including, where applicable, the jurisdiction of the court of the consumer's place of residence.
Applicable law. The choice of Belgian law in article 19 does not deprive a consumer of the protection of the mandatory provisions of the law of the country where the consumer has his habitual residence.
Pre-contractual information. N-Works 3D provides the consumer with the pre-contractual information required by law before the contract is concluded.
